How do you appeal an SBA size determination?

An SBA Area Office size determination can be appealed to SBA's Office of Hearings and Appeals (OHA) within 15 calendar days of receiving the written determination. OHA conducts a de novo review β€” it reconsiders the full factual record, not just whether the Area Office made a legal error. Either party (the protesting firm or the challenged firm) may appeal. OHA decisions are final and binding on the contracting officer.
